Welcome to Gerber Logistics Shipping These Terms & Conditions (“Terms”) govern your use of our website, customer account, package receiving, package forwarding, shipping, payment, and related services.

By creating an account or using our services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or services.

1. OUR SERVICES

Gerber Logistics Shipping provides package receiving, package forwarding, shipping, tracking, and related logistics services between the United States and Jamaica.

Our services may include:

  • Providing customers with a U.S. shipping address

  • Receiving packages on behalf of customers

  • Identifying and processing packages

  • Package storage

  • Package photographs

  • Shipment preparation

  • International forwarding to Jamaica

  • Tracking and delivery notifications

  • Customer support

We reserve the right to modify, suspend, or discontinue any service at any time when reasonably necessary.

2. CUSTOMER ACCOUNT

To use certain services, you must create a customer account.

You agree to provide accurate, complete, and current information, including:

  • Full legal name

  • Email address

  • Phone number

  • Billing information

  • Shipping information

  • Other information reasonably required to provide our services

You are responsible for keeping your account information accurate and up to date.

You are also responsible for maintaining the confidentiality of your account credentials and for all activity occurring through your account.

If you believe your account has been accessed without authorization, you must notify us immediately.

3. PERSONAL U.S. SHIPPING ADDRESS

When you create an account, we may assign you a personal U.S. shipping address.

This address is provided solely for receiving packages on your behalf through our services.

You agree to use the assigned address exactly as provided, including your name and assigned unit/customer identification.

You are responsible for ensuring that online orders contain the correct:

Customer Name + Customer ID/Unit Number + U.S. Shipping Address

We are not responsible for delays, misidentified packages, lost packages, or additional charges resulting from incorrect or incomplete shipping information provided by the customer.

4. PACKAGES AND RECEIVING

When a package arrives at our facility, we may:

  • Record the package information

  • Scan or record the tracking number

  • Photograph the package

  • Record package weight and dimensions

  • Associate the package with your account

  • Inspect the exterior of the package

  • Prepare the package for forwarding

We may open or inspect packages when reasonably necessary for security, customs, legal, carrier, or service-related purposes.

5. PACKAGE IDENTIFICATION

Customers must use the correct name and assigned customer identification when shipping packages to our U.S. facility.

If we cannot reasonably identify the recipient of a package, we may contact the customer, place the package on hold, return it to the sender, or take another reasonable action.

We are not responsible for delays caused by missing or incorrect customer information.

6. PACKAGE PHOTOGRAPHS

We may photograph packages received at our facility for identification, security, inventory, and customer service purposes.

Package photographs may be made available through your customer account or included in service-related communications.

7. PROHIBITED ITEMS

Customers may not use our services to ship or forward items that are prohibited by applicable laws, regulations, carriers, customs authorities, or our company policies.

Prohibited or restricted items may include, without limitation:

  • Illegal drugs or controlled substances

  • Weapons and ammunition

  • Explosives

  • Hazardous or dangerous materials

  • Flammable materials

  • Counterfeit goods

  • Stolen goods

  • Items prohibited by customs authorities

  • Items prohibited by airlines or shipping carriers

  • Other items that cannot legally or safely be transported

The list of prohibited items may change depending on applicable laws, carrier requirements, and destination-country regulations.

We reserve the right to refuse, hold, return, dispose of, or report prohibited items when legally permitted or required.

8. CUSTOMS AND IMPORT REQUIREMENTS

Customers are responsible for complying with applicable customs and import laws and regulations.

You are responsible for providing accurate information about the contents and value of your shipment.

Customs duties, taxes, fees, inspections, and other charges imposed by Jamaican authorities or other government agencies are the responsibility of the customer unless otherwise stated by us.

We do not guarantee that a shipment will be cleared by customs.

Customs authorities may inspect, delay, seize, or refuse a shipment in accordance with applicable law.

9. SHIPPING FEES

Shipping charges may be calculated based on factors including:

  • Package weight

  • Package dimensions

  • Shipping method

  • Destination

  • Number of packages

  • Special handling requirements

  • Carrier charges

  • Applicable taxes or fees

All applicable charges must be paid before shipment unless we have agreed otherwise in writing.

We reserve the right to update our rates and fees at any time.

10. PAYMENTS

Customers agree to provide valid payment information and authorize us or our payment processor to charge the applicable fees.

If a payment fails, is reversed, disputed, or charged back, we may suspend services or place the customer’s account and packages on hold until the outstanding balance is resolved.

Additional fees may apply where permitted by law.

11. REFUNDS

Refund eligibility depends on the type of service purchased and whether the service has already been performed.

Shipping charges may be non-refundable once a shipment has been processed, handed to a carrier, or shipped.

Any approved refund will generally be returned using the original payment method unless otherwise agreed.

Certain third-party carrier charges may not be refundable.

12. PACKAGE STORAGE

Packages received at our facility may be stored for a limited period before shipment.

If a package remains unclaimed or unpaid beyond the applicable storage period, we may charge storage fees or take other reasonable action, including returning or disposing of the package where permitted by law.

The applicable storage period and fees may be communicated through our website, customer account, invoice, or other service communications.

13. SHIPPING DELAYS

Shipping and delivery times are estimates and are not guaranteed unless specifically stated in writing.

Delays may occur due to:

  • Customs processing

  • Weather

  • Transportation disruptions

  • Carrier delays

  • Government actions

  • Port or airport delays

  • Incorrect addresses

  • Security inspections

  • Holidays

  • Unforeseen circumstances

  • Events beyond our reasonable control

We are not responsible for delays caused by circumstances outside our reasonable control.

14. LOST OR DAMAGED PACKAGES

Once a package is transferred to a third-party carrier, the carrier’s terms and conditions may apply.

If a package is lost or damaged during transportation, we may assist the customer with the carrier’s claim process where applicable.

Any compensation is subject to the carrier’s policies, applicable insurance coverage, declared value, and applicable law.

15. CUSTOMER RESPONSIBILITY FOR PACKAGE CONTENTS

The customer is responsible for ensuring that all items shipped through our services are legal, accurately declared, properly described, and permitted for transportation.

The customer agrees not to use our services for illegal activities or to intentionally misrepresent the contents or value of a package.

We may suspend or terminate an account if we reasonably believe the customer has violated these Terms.

16. LIABILITY LIMITATION

To the maximum extent permitted by applicable law, Gerber Logistics Shipping will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our services.

We are not responsible for losses caused by:

  • Incorrect information provided by the customer

  • Incorrect shipping addresses

  • Carrier delays

  • Customs actions

  • Government actions

  • Prohibited or improperly declared items

  • Events beyond our reasonable control

  • Delays caused by third parties

  • Unauthorized access resulting from the customer’s failure to protect account credentials

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

17. ACCOUNT SUSPENSION OR TERMINATION

We may suspend or terminate your account if:

  • You violate these Terms

  • You provide false or misleading information

  • You fail to pay amounts owed

  • You attempt to ship prohibited items

  • Your account is involved in fraud or suspicious activity

  • Your use of the service creates a security or legal risk

  • We are required to do so by law

Termination does not eliminate any outstanding payment obligations.

18. WEBSITE USE

You agree not to:

  • Use the website for unlawful purposes

  • Attempt to gain unauthorized access to our systems

  • Interfere with website security

  • Upload malicious software

  • Attempt to access another customer’s account

  • Use automated systems to abuse the website

  • Provide false information

  • Use our services to facilitate illegal activity

We may restrict or terminate access to users who violate these requirements.

19. INTELLECTUAL PROPERTY

All website content, including logos, trademarks, graphics, text, designs, software, and other materials belonging to Gerber Logistics Shipping is protected by applicable intellectual property laws.
